USPTO Rules in Favor of MacPractice Over HealthWare in Trademark Dispute

Lincoln, NE, December 30, 2005 - United States Patent and Trademark Office (USPTO) has entered formal judgment (Opposition No. 91165660) in favor of MacPractice, Inc. and against HealthWare Corporation, sustaining MacPractice's opposition to the HealthWare registration application for the MacPractice trademark and refusing registration of the mark to HealthWare.

MacPractice first used the MacPractice name for its products, MacPractice MD, MacPractice DDS and MacPractice DC, on May 3, 2004. Two months afterwards, in July, 2004, Michael B. Edwards, CEO of HealthWare and former CEO of now defunct HealthCare Communications, applied to the USPTO for the mark of MacPractice "in use." HealthWare filed an abandonment of its application on November 23, 2005, in advance of the judgment.
